This volume contains 3 papers published here for the first time as well as 13 studies from the years 1979-2001 in revised and in part expanded form.

Der erste Teil1 dieses Forschungsberichts gab einen Überblick über die philologisch-philosophische Erschließung der Schriften des Nikolaus von Kues durch Editionen und Übersetzungen. Die Fortsetzung behandelt: die historische Forschung zur Lebensgeschichte und Interpretationsversuche und vergleichende Studien.

Diese Monographie über Nikolaus von Kues (1401-1464) stellt auf der Grundlage der historischen Forschung des letzten Jahrhunderts im ersten Teil das Leben des Kardinals und einflussreichen römischen Kirchenpolitikers dar. Sie skizziert im zweiten Teil das Werk seiner philosophisch-theologischen, kirchen- und staatspolitischen sowie der mathematischen und naturwissenschaftlichen Schriften in Einzeldarstellungen, um im dritten Teil die Lehre unter systematisierenden Aspekten nach thematischen Gesichtspunkten darzulegen. Im vierten Teil geht der Autor auf der Grundlage einer jahrzehntelangen Arbeit mit historisch-kritischer Quellen- und Wirkungsgeschichte der Nachwirkung (...) dieser Lehre im Umkreis des Nikolaus von Kues und deren Fortwirken vom 16. bis ins 20. Jahrhundert nach. Alle Teile werden durch umfangreiche bibliographische Verzeichnisse im Sinn einer "bibliographie raisonnée" erschlossen, die auch die aus Anlass des 600. Geburtstags und des 550. The extant manuscripts of Nicholas of Cusa’s private library are not only a unique testimony to the reading world of one of the most important philosophers of the 15th century. They also document the material context of a specific literary activity by their reader: as is well known, Cusanus frequently annotated his books, noting his thoughts in the margins. This paper focuses on Cusanus’ marginalia as an object of research and edition. In a first step, the essay reconstructs the 20th-century (...) editorial history of this special textual tradition and embeds it in the developments of the modern philological and historiographical work on Nicholas of Cusa. In a second step, it offers an interpretation of Cusanus’ marginalia as a coherent textual corpus and investigates the reading and writing practices to which this corpus bears witness. Finally, against this background, the paper presents a case for the scientific relevance of a continuation and re-conception of the critical edition of Cusanus’ marginalia, which began in 1941 with the first volume of the series Cusanus-Texte III. Belief in the benevolence of free markets has become a fundamental credo of professional experts, economists, business people and politicians. We regard this discourse as part of a new culture of markets, which has also taken root in Southeast Asia. Expanding markets and using high-tech devices of communication are interpreted as cultural systems that are used in the construction of modernity. An `unbridled romanticism of productivity' (Baudrillard) and a `romance of capitalism' are the meta-narratives underlying the culture of markets. This (...) theme is followed up on two empirical levels. The development policy of three Southeast Asian governments, namely Malaysia, Vietnam and Indonesia, is briefly characterized as market corporatism, market socialism and high-tech developmentalism. We then focus on the emergence of the new middle classes, their actual and symbolic consumption and their lifestyles. Finally the decline of real markets, the creation of virtual markets and the state of postmodernity in Southeast Asia are discussed. We conclude that market fundamentalism and postmodern lifestyles characterize the beginning rather than the end of modernity in Southeast Asia. (shrink)

This workshop on stochastic theory and adaptive control assembled many of the leading researchers on stochastic control and stochastic adaptive control to increase scientific exchange and cooperative research between these two subfields of stochastic analysis. The papers included in the proceedings include survey and research. They describe both theoretical results and applications of adaptive control. At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). Oft wird nur jenes anerkannt, was "wissenschaftlich beweisbar" ist. Ein solches Vorurteil vergisst, dass es auch andere Wirklichkeiten gibt. Ist unsere Welt ein Blick durch ein Kaleidoskop? Wie kann es sein, dass man eine mehr oder minder große Auswahl panoramenhafter Wirklichkeiten vor sich hat? Ist es möglich, solche Wirklichkeiten zu verlassen und in andere überzuwechseln? Anhand konkreter Beispiele wird dieser Wirklichkeits-Pluralismus beleuchtet. Das erste Beispiel, ein astronomisches, zeigt in aller Ausführlichkeit, auf welche Weise Wirklichkeit entstehen kann. In the enquiry into the import and function of the basic norm in Hans Kelsen's legal theory, the interpretations of special interest are those dealing with the notion of the basic norm as the ‘logico-transcendental’ condition for cognition in legal science, or with the relation of Kelsen's juridico-scientific method to Kant's practice philosophy. Two thinkers in particular have written along these lines, Norbert Leser and Ralf Dreier, respectively. This chapter begins by describing the positions taken up by the two (...) authors. It then asks, whether in terms of Leser's thesis, it is in fact possible to maintain the notion of the transcendental character of the basic norm. It then turns to Dreier's suggested reinterpretation of the basic norm by appeal to the law of reason, examining the suggestion from the point of view of Kant's philosophy. (shrink)

Machines will attain human levels of intelligence by the year 2040, predicts robotics expert Hans Moravec. And by 2050, they will have far surpassed us. Ever since Democritus of Abdera (460-370 B.c.E.) introduced the concept of atoms in Western thought, later to be elaborated by Epicuros (as transmitted by Diogenes Laertius) and Lucretius, it lay at the basis of materialistic and atheist world views. Therefore, it may be less surprising to know that as late as 1624 in France, the teaching of atomism was a crime punishable by death. Even when atoms had been accepted, after the time of John Dalton (1766-1844), and indeed were considered (...) indispensable by chemists, resistance against them continued among many physicists. Ludwig Boltzmann, who derived the laws of thermodynamics from the hypothetical existence of "atoms" was the foremost advocate of atomism in the nineteenth century, while another Austrian, Ernst Mach, was its most prominent opponent. Einstein’s first articles were entirely within the Boltzmann tradition. As he explained in his autobiography, his work on fluctuations and Brownian motion was undertaken because of his desire to guarantee the existence of atoms of definite finite size. Boltzmann’s statistical methods were also used by Max Planck for the quantum hypothesis of light, so &dquo;both roots of quantum theory, the Planck root and the Einstein root, go back to Boltzmann&dquo; (Boltzmann, 1981). Schnell verlagerte sich mein Interesse fast vollständig auf die Philosophie, hatte doch das damalige Institut für alle, die sich von grundlegenden Fragestellungen bedrängt fühlten, einiges zu bieten.

The Diagnostic Understanding of Gestalt Theoretical Psychotherapy: In accordance with the basic thoughts of the Guideline, Gestalt Theoretical Psychotherapy acts on the conviction that diagnostic revelations and therapeutic change processes are inseparable. Even if each of them is related to different functions and thus to particular demands, an efficient patient support requires the professional and proper interplay of discovery and change processes throughout her therapy. Each new discovery is per se related to a change and may set off a series (...) of further changes, which may again trigger off new discoveries. As widely known, this may also happen when this whole process and this cause-and-effect-relation are neither intended, nor planned, nor insightfully administered or understood. The authors of the Guideline are, therefore, right to not only ascertain the fact that discovering and changing in psychotherapy are joint and intertwining processes, but also to postulate that the psychotherapist has to work on this intertwining process consciously and deliberately, guided by and in accordance with her particular scientific-methodological approach. Even in the diagnostic strand of psychotherapeutic work, Gestalt Theoretical psychotherapists let themselves be guided by the “characteristics of working at the living”, as they were elaborated by Wolfgang Metzger (1962) and transferred to psychotherapeutic applications by Hans-Jürgen P. Walter (1977) and his colleagues. Simultaneously, essential anthropological, epistemological and ethical home positions of Gestalt theory are concisely expressed therein. I am going to mention them briefly, reformulating them in reference to the diagnostic remit. By doing so, the accordance with the major viewpoints of the Guideline in the description of diagnostic processes in psychotherapy should become apparent. (shrink)

Two key ideas of scientific explanation−explanation as causal information and explanation as unification-have frequently been set into mutual opposition. This paper proposes a “dialectical solution” to this conflict, by arguing that causal explanations are preferable to non-causal ones, because they lead to a higherdegree of unification at the level of explaining statistical regularities. The core axioms of the theory of causal nets (TC) are justified because they offer the best if not the only unifying explanation of two statistical phenomena: screening (...) off and linking up. Alternative explanations of the two phenomena are discussed and it isshown why they don’t work. It is demonstrated that although the core axioms of TC are empirically vacuous, extended versions of TC have empirical content by means of which they can generate independently testable predictions.Con frecuencia se han planteado como contrapuestas dos ideas clave en la explicacion cientifica (explicacion como informacion causal y explicacion como unificacion). El presente articulo propone una “solucion dialectica” argumentando que las explicaciones causales son preferibles a las no-causales porque aquellas comportan un mayor grado de unificacion en la explicacion de regularidades estadisticas. Los axiomas centrales de la teoria de redes causales (TC) estan justificados porque ofrecen la mejor, si no la unica, explicacion unificada de dos fenomenos estadisticos: neutralizacion (screening off) y vinculacion (linking up). Se discuten las explicaciones alternativas de estos dos fenomenos y se razona por que no funcionan. Se demuestra ademas que aunque los axiomas centrales de TC son empiricamente vacuos, las versiones extendidas de TC tienen un contenido empirico gracias al cual pueden generar predicciones independientemente contrastables. Ever since Aristotle's famous argument about the sea-battle tomorrow, there has been intensive and controversial discussion among philosophers whether the truth of statements about the future leads to determinism. Ther e is controversy about Aristotle's own solution to the problem, as well as the views of classical and medieval commentators on Aristotle. Seel's book attempts to answer this question for the Neoplatonist Ammonius (5th-6th century AD). In so doing, he also opens up new insights into Neoplatonic thought.

Johannes von Kries (1853-1928) left a fascinating work: As a physiologist, he had a lasting influence on research into colour perception. As a philosopher, he formulated a theory of probability which was received not only in philosophy (Hans Reichenbach, Ludwig Wittgenstein), but also in physics (Ludwig Boltzmann, Max Planck), jurisprudence (Gustav Radbruch), sociology (Alfred Schütz, Max Weber), economics (John Maynard Keynes), and belles-lettres (Robert Musil). In lieu of an abstract, here is a brief excerpt of the content:Spinoza and the Theory of Organism HANS JONAS I CARTESIANDUALISMlanded speculation on the nature of life in an impasse: intelligible as, on principles of mechanics, the correlation of structure and function became within the res extensa, that of structure-plus-function with feeling or experience (modes of the res cogitans) was lost in the bifurcation, and thereby the fact of life itself became unintelligible at the same time that the (...) explanation of its bodily performance seemed to be assured. The impasse became manifest in Occasionalism : its tour de force of an extraneous, divine "synchronization" of the outer and the inner world (the latter denied to animals) not only suffered from its extreme artificiality, the common failing of such ad hoc constructions, but even at so high a cost failed to accomplish its theoretical purpose by its own terms. For the animal machine, like any machine, raises beyond the question of the "how" that of the "what for" of its functioning---of the purpose for which it had thus been constructed by its maker.1 Its performance, however devoid of immanent teleology, must serve an end, and that end must be someone's end. This end may (directly) be itself, as indeed Descartes had implied when declaring self-preservation to be the effect of the functioning of the organic automaton. In that case the existence as such of the machine would be its end--either terminally, or in turn to benefit something else. In the former case, the machine would have to be more than a machine, for a mere machine cannot enioy its existence. But since, by the rigorous conception of the res extensa, it cannot be more than a machine, its function and/or existence must serve something other than itself. Automata in Descartes ' time were mainly for entertainment (rather than work). But the raison d'etre of the living kingdom could not well be seen in God's indulging his mechanical abilities or in the amusement of celestial spectators--especially since mere complexity of arrangement does not create new quality and thus add something to the unrelieved sameness of the simple substratum that might enrich the spectrum of being. For quality, beyond the primitive determinations of the extended per se, is the subjective creature of sensation, the confused representation of quantity in a mind; and thus organisms cannot harbor it because as mere machines they lack mentality, and pure spirits cannot because they lack sensuality, or the privilege of confusion and thereby of illusion with its possible enjoyment. Who are the real targets of Kierkegaard’s critique of characterizing faith as “the immediate”? A decisive factor in answering this question is the interpretation and dating of the note Pap. I A 273 / Papir 92, in which Kierkegaard equates that which Friedrich Schleiermacher calls ‘religion’ and “the Hegelian dogmaticians” call ‘faith’ with “the first immediate.” After deli-neating the factual context of the expression “the first immediate” in Section I, I will question to what extent this critique of Schleiermacher is (...) justified in Section II. Sections III-V will look at the problem of identifying “the Hegelian dogmaticians.” Here I hope to show that it is not Philipp Konrad Marheineke, but rather Kierkegaard’s contemporaries in Copenhagen, Hans Lassen Martensen and Johan Ludvig Heiberg, who should be considered the particular targets of Kierkegaard’s critique.
